Effective Date: September 15, 2026

Welcome to D&S Lawns and Gardens. These Terms and Conditions (“Terms”) govern the services we provide to our customers and the use of our website, service requests, estimates, scheduling, invoicing, payments, and customer communications.

By requesting, scheduling, or receiving services from D&S Lawns and Gardens, you agree to these Terms.

1. About D&S Lawns and Gardens

D&S Lawns and Gardens provides residential and property maintenance services, including lawn and yard maintenance, mowing, edging, trimming, weed control, plant and shrub maintenance, tree and fruit-tree care, irrigation inspection and related maintenance, cleanup, planting, and other landscaping services as agreed upon with the customer.

Services provided will depend on the scope of work agreed upon between D&S Lawns and Gardens and the customer.

2. Estimates and Service Approval

Estimates are based on the information available at the time they are prepared. The final price may change if the scope of work changes, additional work is requested, or conditions at the property differ substantially from those observed when the estimate was prepared.

Work requiring customer approval will generally be performed after the customer accepts the estimate or otherwise authorizes the work.

Additional services or changes to the scope of work may result in additional charges.

3. Scheduling and Service

D&S Lawns and Gardens will make reasonable efforts to arrive on the scheduled date and within the scheduled service window.

Schedules may occasionally change because of weather, equipment issues, emergencies, property access, or other circumstances beyond our reasonable control.

Customers are responsible for providing reasonable access to the property and informing D&S Lawns and Gardens of known hazards, locked gates, pets, irrigation issues, or other conditions that may affect the service.

4. Customer Responsibilities

Customers are responsible for:

Providing accurate contact and property information.
Providing reasonable access to the areas where services are requested.
Removing or securing personal items that could interfere with the work.
Informing D&S Lawns and Gardens about known hazards or special property conditions.
Keeping children and pets away from work areas when requested for safety purposes.
Providing accurate payment information when applicable.

D&S Lawns and Gardens is not responsible for damage to personal items that were not reasonably visible or were left in areas where services were being performed.

5. Payments and Invoices

Invoices are issued for services provided or according to the payment schedule agreed upon with the customer.

Customers agree to pay invoices according to the payment terms shown on the invoice, estimate, or service agreement.

D&S Lawns and Gardens may accept available payment methods offered through its invoicing and payment systems, including electronic payment methods and other payment methods communicated to the customer.

Any applicable deposits, prepaid services, recurring payments, or payment arrangements will be communicated to the customer before or during the agreement.

6. Cancellations and Rescheduling

Customers should provide reasonable notice when they need to cancel or reschedule a service.

D&S Lawns and Gardens may reschedule services when weather, unsafe conditions, equipment problems, or circumstances beyond our reasonable control prevent the service from being completed safely or properly.

Any applicable cancellation fees or special cancellation terms will be communicated to the customer when applicable.

7. Property Conditions and Safety

Landscaping and yard maintenance may involve equipment, tools, vehicles, plants, irrigation systems, and other conditions that can present safety risks.

D&S Lawns and Gardens will make reasonable efforts to perform services safely and professionally.

Customers must disclose known hazards, including underground or concealed conditions that may affect the work.

D&S Lawns and Gardens is not responsible for damage resulting from undisclosed underground utilities, concealed irrigation components, hidden objects, unstable structures, or other conditions that could not reasonably be identified before or during the service.

8. Irrigation and Plant Care

Irrigation systems, plants, trees, lawns, and other landscape materials can be affected by weather, soil conditions, pests, disease, existing system conditions, water pressure, environmental conditions, and other factors outside our control.

Irrigation inspections or adjustments do not guarantee that a system will operate without future problems.

Planting, pruning, trimming, irrigation work, and landscape maintenance are performed based on the conditions observed at the property and the scope of service agreed upon with the customer.

9. Changes to Services

Customers may request additional services or changes to scheduled work.

D&S Lawns and Gardens may provide an updated estimate or additional charge before performing work outside the original scope.
